01 Description of Service
Orbit Dodge is a mobile game designed for entertainment, allowing users to dodge flying asteroids by orbiting a central star. The Game is distributed through the Apple App Store and Google Play. All gameplay progress, settings, and high scores are saved locally on your device, and we do not store your game files or scores on our own servers.
02 License to Use the Game
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and play the Game on devices you own or control, solely for your personal, non-commercial entertainment. This license is subject to the usage rules set forth by Apple's App Store Terms of Service and Google Play's Terms of Service.
03 Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to play this Game. If you are under 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
04 Acceptable Use & Fair Play
You agree to play the Game in a fair and respectful manner. You must not:
- Modify, hack, cheat, bypass, or exploit any game mechanics, values, or completed levels to gain an unfair advantage or manipulate high scores;
- Decompile, disassemble, reverse-engineer, or attempt to extract the source code or assets of the Game;
- Distribute modified or unauthorized versions of the Game;
- Use bots, scripts, or automated software to operate the Game;
- Interfere with the security features of the Game or the delivery of advertisements.
05 In-App Purchases & Advertising
The Game is free to play and is supported by advertising. It may offer optional, one-time in-app purchases (such as "Remove Ads" or secondary shields) to enhance your gameplay experience.
All in-app purchases are handled securely through Apple's App Store or Google Play's billing engine. These transactions are subject to the platform's terms of service and billing rules. All purchases are final and non-refundable, except where required by law or local platform rules. Deleting the Game may result in the loss of local progress; however, purchases can generally be restored through the settings screen in the Game.
06 Intellectual Property Rights
All intellectual property rights in the Game, including but not limited to source code, algorithms, game designs, visual artwork, UI elements, audio tracks, and o9tech branding, are owned by us or our licensors. These materials are protected by international copyright, trademark, and other intellectual property laws. Except for the limited play license granted in Section 2, no ownership rights are transferred to you.
07 Third-Party Services
The Game integrates third-party services to display advertising (Google AdMob) and manage local platform features (like Apple Game Center or Google Play Games). These third-party services operate under their own terms of service and privacy policies, and we are not responsible for their availability, content, or practices.
08 Disclaimer of Warranties
THE GAME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL RUN UNINTERRUPTED, BUG-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.
09 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL O9TECH, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO PLAY THE GAME, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU, IF ANY, FOR IN-APP PURCHASES IN THE GAME DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10 Indemnification
You agree to defend, indemnify, and hold harmless o9tech and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your breach of these Terms, your misuse of the Game, or your violation of any third-party rights.
11 Termination
We reserve the right to modify, suspend, or terminate your license to use the Game, or discontinue the Game entirely, at any time without notice. Upon termination, you must stop playing the Game and delete it from all your devices.
12 Changes to These Terms
We may update these Terms from time to time. When we make updates, we will update the "Effective Date" at the top of this page. Your continued use of the Game after any changes constitutes your acceptance of the updated Terms.
